    Who is qualified to serve as an external member of the Internal Complaints Committee (ICC)?

    The external member must be a person who is not an employee of the organisation and is either an NGO Member, or a member of an association committed to the cause of women or a person familiar with issues relating to sexual harassment, as per Section 4(2)(c) of the PoSH Act.

    Why is it mandatory for every ICC to include an external member under the PoSH Act?

    An external member’s independent perspective reduces internal bias, strengthens legal compliance, and builds trust among employees; this ensures impartiality, transparency, and fairness in ICC proceedings. These requirements safeguard the credibility and objectivity of the inquiry process under the Act.

    What are the risks or liabilities of appointing an external member who does not meet PoSH compliance requirements?

    Appointing an unqualified external member can invalidate the ICC and expose the organisation to legal, financial, and reputational risks. Such lapses can result in the inquiry outcome being disputed.

    How are ICC external members expected to maintain confidentiality during inquiries and proceedings?

    Just like any ICC member, external members too must maintain strict confidentiality of all identities and case details. Disclosure is prohibited except when allowed by the law. Breach of this duty can lead to penalties and also have an impact on the inquiry’s fairness.
